Terms of Service

1. Acceptance of Terms
By accessing or using InfraWatch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Infrawatcher AI is a software-as-a-service (SaaS) infrastructure monitoring platform that provides automated health checks for DNS records, SSL certificates, HTTP endpoints, WebSocket connections, cloud services (including AWS Elastic Beanstalk and RDS), and database services (including MongoDB Atlas, Supabase, Redis, and others). The Service also includes AI-powered failure diagnosis, alerting integrations, and an optional AI agent add-on.
3. Account Registration
To use the Service, you must create an account by authenticating through our supported OAuth provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription and Billing
The Service is offered on a subscription basis. By selecting a paid plan, you agree to pay the applicable subscription fees. All fees are billed in advance on a monthly basis and are non-refundable except as required by law. We use Stripe to process payments. Your payment information is transmitted directly to Stripe and is not stored on our servers. Subscription fees may change upon thirty (30) days' notice. Continued use of the Service after a fee change constitutes acceptance of the new fees.
5. Credential Storage and Security
The Service allows you to store third-party credentials (such as AWS IAM keys and MongoDB Atlas API keys) to enable infrastructure monitoring. All stored credentials are encrypted at rest using AES-256-GCM encryption. You are solely responsible for ensuring that any credentials you provide have the minimum necessary permissions for monitoring purposes. We recommend using read-only IAM roles and API keys where possible. You acknowledge that storing credentials with the Service carries inherent risk and you assume responsibility for any consequences arising from credential compromise.
6. Acceptable Use
You agree not to use the Service to: (a) monitor infrastructure you do not own or have explicit authorization to monitor; (b) attempt to circumvent rate limits or security controls; (c) use the Service in any way that violates applicable laws or regulations; (d) resell or sublicense access to the Service without our written consent; or (e) use the AI agent or Detect & Propose features to generate content that is harmful, misleading, or violates third-party rights.
7. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, unexpected outages, or factors outside our control may result in temporary unavailability. We are not liable for any losses arising from Service downtime. Health check results are provided for informational purposes and should not be the sole basis for critical operational decisions.
8. AI Features Disclaimer
The Detect & Propose and Talk to Infrawatcher AI Agent features use large language models to generate infrastructure diagnoses and proposed fixes. These outputs are advisory only and are provided for your review before any action is taken. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content. You are solely responsible for evaluating and acting on any proposed fixes. We are not liable for any damages arising from reliance on AI-generated recommendations.
9. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of InfraWatch and its licensors. You retain ownership of any data, credentials, and documentation you upload to the Service. By uploading content to the knowledge base, you grant us a limited, non-exclusive license to process and store that content solely for the purpose of providing the Service to you.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Infrawatcher AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, by email. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
